DMCA Policy
Exert respects intellectual property rights and complies with the Digital Millennium Copyright Act (“DMCA”). If you believe that content on Exert infringes your copyright, please follow the process below.
1. Filing a Takedown Notice
To submit a DMCA takedown notice, send an email to support@exert-app.com with all of the following information:
- Identification of the work — a description of the copyrighted work you believe has been infringed, or a representative list if multiple works are covered.
- Identification of the infringing material — the specific URL(s) on Exert where the allegedly infringing content is located, with enough detail for us to locate it.
- Your contact information — your name, postal address, telephone number, and email address.
- Good faith statement — a statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- Accuracy statement— a statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf.
- Signature — your physical or electronic signature.
2. What Happens After You Submit
Upon receiving a valid DMCA notice, we will act expeditiously to remove or disable access to the allegedly infringing content. We will notify the user who posted the content that it has been removed, and we may forward your notice (excluding personal contact details) to that user.
3. Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification to dmca@exert-app.com containing:
- Identification of the removed content and its former location.
- A statement under penalty of perjury that you have a good faith belief the content was removed as a result of a mistake or misidentification.
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the courts in England and Wales.
- Your physical or electronic signature.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.
4. Repeat Infringers
Exert will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances, in accordance with our Terms of Service.
