Please read these Terms of Service (“Terms”) carefully before using Exert (“we”, “us”, or “our”). By accessing or using Exert, you agree to be bound by these Terms. If you do not agree, do not use the service.

By creating an account, browsing programs, or otherwise accessing Exert, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. These Terms form a binding legal agreement between you and Exert. If you are using Exert on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Service Description
Exert is a community marketplace for workout programs. It allows users to publish, discover, fork, and track strength and conditioning training programs. The service connects coaches and athletes and enables programme customisation through forking. Features include program browsing and discovery, session logging, progress tracking, reviews, and creator profiles.
3. Eligibility & Accounts
You must be at least 18 years old to create an account. By registering, you represent that all information you provide is accurate and up to date. You may hold only one account per person. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. 4. User-Generated Content
You retain ownership of the workout programs, descriptions, and other content you create (“Your Content”). By submitting Your Content to Exert, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and make Your Content available to other users as part of the service. You are solely responsible for the accuracy, safety, and legality of Your Content, including any fitness advice, exercise prescriptions, or nutritional guidance you publish.
5. Acceptable Use
When using Exert you agree not to:
- Post spam, unsolicited promotions, or duplicate content
- Publish fitness advice that is dangerous, misleading, or not supported by reasonable evidence
- Impersonate any person, organisation, or certified professional
- Scrape, crawl, or otherwise systematically extract data from the service without written permission
- Attempt to gain unauthorised access to other accounts or our systems
- Use the service in any way that violates applicable laws or regulations
6. Medical & Fitness Disclaimer
The programs, content, and information on Exert are not medical advice and are not a substitute for professional medical or physiotherapy guidance. Before beginning any new exercise programme, particularly if you have a pre-existing medical condition, injury, or health concern, consult a qualified healthcare professional. Exercise carries inherent risks, including risk of injury or death. Exert, its operators, and its contributors are not liable for any injury, illness, or adverse outcome arising from following programs or advice found on the platform. You participate in any training programme entirely at your own risk.
7. Intellectual Property
The Exert name, logo, design, and underlying software are the intellectual property of Exert and may not be used without prior written consent. When you fork another user's programme, you receive a copy of that programme for your personal use and customisation. Forking does not transfer ownership of the original content or grant you the right to republish it as your own without appropriate attribution to the original creator.
8. DMCA & Copyright
Exert respects intellectual property rights. If you believe that content on Exert infringes your copyright, please send a DMCA takedown notice to [contact email] containing: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the infringing material and its location on the service; (c) your contact information; (d) a statement of good faith belief; and (e) a statement of accuracy under penalty of perjury. We will process valid notices promptly.
9. Disclaimers & Limitation of Liability
The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, Exert shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the service. Our total liability to you for any claim shall not exceed the greater of the amounts you have paid us in the twelve months preceding the claim or $100 USD.
10. Termination
We may suspend or terminate your account and access to the service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to other users or to Exert. You may also delete your account at any time via your account settings. Termination does not affect content that other users have forked prior to termination.
11. Governing Law
